Newsflash: Like most lawyers, I don`t work for free. It`s not cheap to pay a consultant to travel, prepare for, and report to an OTR. Multiply that by several OTRs, and the cost of a broker-trader just to go through an audit – and remember, all this before a complaint is filed or even before the decision to file a complaint is made – can become exorbitant. The types of parts that are often most helpful in these cases are MRIs, CT scans, specific diagnostic tests, surgical records or certain types of procedures that document abnormal results, and doctor`s notes that describe worsening disease progression. OTR is responsible for CBP`s compliance with the Small Business Regulatory Enforcement Fairness Act (SBREFA) and mitigating the resolution of issues that could not be resolved locally at CBP or by another CBP headquarters. Knowing this, and because testifying at an OTR can be a scary experience for the uninitiated and experienced witnesses, since FINRA always needs a lawyer to assist with questioning, most reasonable people, especially those who can afford it, bring a lawyer to an OTR.
