In response, human rights first project: Afghan Legal Assistance (PALA) was launched to coordinate U.S. legal organizations, law firms, resettlement agencies, and other stakeholders to coordinate the legal representation of Afghans in the United States.
PALA`s efforts to warmly and dignify Welcome Afghans to the United States can make a profound difference in their lives. In addition, PALA works with partner organizations to provide training and materials to volunteer lawyers, community organizations and legal service providers. Individuals who have previously attended or attended a registered legal orientation session are encouraged to visit the IJC`s Legal Resources for Afghan Asylum Seekers and other forms of assistance. The Afghanistan Response Project is a collaboration between ACA agencies, members and staff. As the world`s largest organization of lawyers, ABA members are well positioned to reduce the burden on those who suffer in crisis situations. In addition, the U.S. legal profession has a long tradition of pro bono service, as evidenced by the ABA`s Standard Rules of Professional Liability, which have been adopted in whole or to a large extent by most states. The ABA therefore encourages lawyers to use their skills to address the legal needs of Afghan refugees and those in Afghanistan who continue to need their advocacy. When the United States completed the withdrawal of its forces from Afghanistan in August, the American Bar Association began responding to the needs of Afghans. First, this assistance took the form of ABA members and volunteer members preparing letters of recommendation for the evacuation of Afghans applying for special immigrant visas. Priority 3 (P3) status (or “family reunification status”) is granted to spouses, unmarried children under the age of 21, or relatives of individuals who have previously been admitted to the United States as refugees or asylum seekers.
P3 application procedures must be carried out outside the country of origin. P3 individuals have access to benefits under the United States Refugee Assistance Program (USRAP). When Afghanistan fell to the Taliban after twenty years of war, thousands of Afghans working throughout civil society were in great danger. Afghans pardoned in the United States after July 31, 2021 and living in Illinois, Indiana or Wisconsin (not on a military base). SIVs are available to individuals who have worked as translators, interpreters, or other professionals employed by or on behalf of the U.S. government in Afghanistan. If you are not eligible for a SIV, P2 or P3, humanitarian parole may be a good option to legally enter the United States. Humanitarian probation is an award of probation justified by the finding that there are “urgent humanitarian grounds” for a person to enter the United States. While the normal maximum duration is 365 days, the U.S. government has announced that Afghans will be entitled to probation of up to two years. Individuals on compassionate probation are eligible for a work permit in the United States, but are not eligible for refugee resettlement programs or other federal benefits.
